Partner Philip Bonoli was quoted in the Law & Crime article “Labor Board Backs USC College Athletes in Case, Arguing They Are ‘Employees’ Who Should Be Paid and Permitted To Unionize.” The article discusses how the National Labor Relations Board is siding with USC student athletes in a case against USC, the Pac-12 Conference, and the NCAA in an attempt to have student athletes across the nation reclassified as “employees” of their respective schools.
Phil presumed it would be “likely” that an administrative law judge would deem student-athletes employees under relevant laws. He adds that as employees, “they could attempt to form a players association, which would be the collective bargaining representative for the players, and would assist players with wages, benefits, grievances and other employment terms and conditions such as health insurance, PTO and retirement benefits.”
