Jeff Kobulnick was interviewed by Bloomberg Law on the intersection of trademark and First Amendment rights in regards to the now-settled trademark infringement lawsuit over rapper Lil Nas X’s “Satan Shoes.” According to Jeff, while people can generally resell copyright- or trademark-protected products under the first sale doctrine, reselling “materially altered” goods may be deemed a violation of the brand owner’s rights as it can damage a brand’s reputation.
