Bagdanov Successfully Represents Chapter 7 Trustee
A February 6, 2018 Bankruptcy Appellate Panel (“BAP”) decision affirmed a judgment of the Bankruptcy Court defended by Jessica Bagdanov in her representation of David Seror, Chapter 7 trustee. The case on appeal was In re Reza Fateh Manesh, regarding a parcel of improved real property in Van Nuys. In the contested adversary proceeding trial, the Honorable Victoria Kaufman, United States Bankruptcy Judge, rendered judgment in the trustee’s favor, determining that the subject property was property of the debtor’ estate. The trial involved providing evidence on a complicated history of title documents, court suits, and conduct of the debtor, his brother (the defendant), and the debtor’s wife and creditors.
Jessica prevailed in navigating through this complex fact pattern, and Judge Kaufman prepared an extended written ruling analyzing the evidence, law and issues and resolving the ultimate question in the trustee’s favor. Upon reviewing the case, the Bankruptcy Appellate Panel affirmed the trial judgment, which included an award of attorneys’ fees against the defendant.
