Jessica Bagdanov Successfully Represents Chapter 7 Trustee
Jessica Bagdanov successfully represented chapter 7 trustee and plaintiff Elissa D. Miller at trial in Miller v. Wood, and the result was announced by The Honorable Vincent Zurzolo at a post-trial hearing convened for the purpose of announcing findings, conclusion and judgment. Jessica was pursuing post-petition transfer claims against entities formed during the debtor’s chapter 11 case by its principal, as well as related breach of fiduciary duty and similar claims against the principal for having orchestrated the transfer of the debtor’s accounts receivable to his two new companies as the case was converting to a chapter 7. Judge Zurzolo gave judgment on many of the trustee’s theories against all the defendants for $64,432.92 jointly and severally, the claim amount for the accounts receivable transferred without court approval. Judge Zurzolo also found the trustee to be the prevailing party in the litigation.
